Terms & Conditions

Service Agreement & Terms and Conditions

This Agreement outlines the expectations, responsibilities, and terms between Greencay Landscaping LLC (“Company,” “we,” or “us”) and the service recipient (“Client”).

By accepting an estimate, proposal, or service from Greencay Landscaping LLC, the Client agrees to the terms outlined below.

1. Term of Agreement

This Agreement becomes effective on the date the Client accepts a quote or estimate from Greencay Landscaping LLC.

  • Recurring services automatically renew unless canceled or price adjustments are made in accordance with this Agreement.
  • This Agreement remains in effect until terminated by either party as outlined herein.

2. Scope of Services

Services provided will be limited to those outlined in the approved estimate, proposal, or service agreement.

  • Any additional work must be approved in advance and may require a separate quote.
  • Unauthorized or assumed work will not be performed.

3. Billing & Payments

Recurring Service Clients

Billing for our recurring services is managed through secure cards on file in the Greencay Landscaping LLC Client Hub powered by JOBBER. The Client Hub can be easily accessed on our website at www.greencaylandscaping.com

What this means for you:

  • Cards are charged only after services are completed
  • Receipts are emailed after each completed service
  • Appointment reminders are sent 24 hours in advance via text and email

What action is required:

  • Clients will receive a secure email link to add a preferred card on file
  • Do not send card information via text or email
  • Card data is stored securely by our payment processor and may be updated anytime in the Client Hub

Client Hub Access:

The Client Hub allows clients to:

  • Approve quotes
  • View appointments
  • Pay invoices
  • Print receipts
  • Request additional services

Invoices & Payment Methods

Accepted payment methods include:

  • Credit/Debit Card (via Client Hub)
  • Cash
  • Check

For landscaping projects or one-time services:

  • Invoices are sent by email/text
  • Payment is due in full by the invoice due date
  • A 10% late fee will be applied to overdue invoices
  • Services will pause until balances are paid in full

Returned checks are subject to a $25 returned check fee.

4. Scheduling, Weather & Cancellations

  • Services may be delayed due to weather or unsafe conditions.
  • Weather-related cancellations will be rescheduled at no cost.

Client Cancellations

  • Clients must provide no later than  24  hours’ notice for personal cancellations.
  • Skipped or canceled biweekly mowing visits are not permitted.
  • If consecutive mowing visits are canceled, an overgrowth fee of 50% will be applied at the next service, if a double cut is required

Landscaping Project Cancellations

  • If a landscaping project is canceled and no materials have been purchased you will receive a full refund. If a landscaping project is canceled and materials have already been purchased, a refund will be issued minus material costs and a $100 cancellation fee will be applied.

5. Property Access & Conditions

  • The Client must provide clear and safe access to the property.
  • The Company is not responsible for delays or incomplete services due to blocked access, locked gates, or unsafe conditions.
  • Personal property may be moved as reasonably necessary; the Company is not responsible for damage to unsecured or undisclosed items.

6. Pet Waste Policy

  • All pet waste must be removed prior to scheduled service.
  • If pet waste is present:
    • A $35 pet waste fee will be added to the invoice

7. Utilities & Underground Infrastructure

Greencay Landscaping LLC is not responsible for damage to:

  • Unmarked sprinkler or irrigation systems
  • Invisible fences
  • Drain tiles, sewer caps, clean-outs
  • Utility lines or underground infrastructure not disclosed or marked

The Client is responsible for identifying and marking all underground utilities prior to service.

8. Lawn, Sod, Seed & Plant Installations

  • The Client is responsible for proper watering and maintenance after installation.
  • Failure due to improper care, lack of watering, weather, pests, or soil conditions is not the responsibility of Greencay Landscaping LLC.
  • No warranty is provided unless stated in writing.

9. Materials & Substitutions

  • Materials will be supplied as specified in the proposal.
  • The Company reserves the right to substitute materials or plant varieties of equal or greater value when availability requires.

10. Quality of Workmanship

  • Services will be performed in a professional manner consistent with industry standards.
  • Workmanship issues must be reported within 7 days of service completion.
  • Verified workmanship defects will be corrected at no additional cost.
  • Issues caused by environmental factors or improper client maintenance are excluded.

11. Independent Contractor

Greencay Landscaping LLC operates as an independent contractor. This Agreement does not create a partnership, joint venture, or employment relationship.

12. Indemnification & Liability

  • The Company shall not be held liable for damages caused by pre-existing conditions, undisclosed hazards, or client negligence.
  • Total liability shall not exceed the amount paid by the Client under this Agreement.
  • The Company is not liable for indirect or consequential damages.

13. Force Majeure

Neither party shall be liable for delays or failure caused by events beyond reasonable control, including severe weather, natural disasters, government actions, or public health emergencies.

14. Governing Law

This Agreement shall be governed by the laws of the State of Ohio, with venue in Cuyahoga County, Ohio.

15. Social Media & Marketing Use

The client grants Greencay Landscaping LLC permission to photograph and/or record video of completed work on the client’s property for documentation, portfolio, website, and social media marketing purposes.

Greencay Landscaping LLC agrees that:

  • Photos and videos will focus on the work performed and not intentionally identify the client
  • No personal or private information will be shared
  • Images will be used in a professional manner only

If the client does not wish to grant this permission, they must notify Greencay Landscaping LLC in writing prior to the start of work.

15. Acceptance of Terms

By signing or accepting an estimate, proposal, or invoice, the Client:

  • Confirms pricing and scope are satisfactory
  • Authorizes Greencay Landscaping LLC to perform services
  • Agrees to these Terms and Conditions
